These Conditions of Sale are concluded on the one hand by the company Eldonia, with a share capital of 40  000€ whose head office is located at 9 avenue des Portes Occitanes, 03800 Gannat, France, registered in the Trade and Companies Register of Cusset under number 44083183200025, hereinafter referred to as Eldonia and managing the site spinosaure.com  and on the other hand, by any natural or legal person wishing to make a purchase via the spinosaure.com website  referred to as "  the buyer  ".

Article 1: object

These conditions of sale aim to define the contractual relationship between Eldonia and the buyer as well as the conditions applicable to any purchase made through the site spinosaure.com.

The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale, which the buyer acknowledges having read prior to his order.

Before any transaction, the buyer declares to have full legal capacity, allowing him to engage under these general conditions of sale.

Eldonia retains the option of modifying these conditions of sale for the spinosaure.com site at any time in order to comply with any new regulations or with the aim of improving the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

Article 2- Products

The products offered are those which appear on the spinosaure.com site of the company Eldonia within the limits of available stocks.

Eldonia reserves the right to modify the assortment of its products at any time. Each product is presented on the spinosaure.com website in the form of a description summarizing its main characteristics.  : scientific name, origin, age etc…

The photographs are as faithful as possible but their rendering and more particularly in terms of colors, may vary depending on the medium used to consult the site (computer, telephone, tablet)

The measurements are made with care but are not guaranteed to the nearest millimeter   .

Article 3- Rates

The prices appearing on the product sheets of the internet catalog are prices in Euros (€) all taxes included (TTC) taking into account the VAT  French applicable on the day of the order. 

Any change in the VAT rate may be passed on to the prices of the products.

Eldonia reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the website on the day of the order will be the only one applicable to the buyer.

The prices indicated in the catalog do not include delivery costs, invoiced in addition to the price of the products purchased according to the weight of the item.

Article 4- Order and terms of payment.

Before any order, the buyer must create an account on the eldonia.fr website. The account creation section is accessible on the spinosaure.com website. At each visit, the buyer, if he wishes to order or consult his account (order status, profiles, etc.) must identify himself. 

The company Eldonia via the site spinosaure.com, offers the buyer to pay for the products ordered with 4 options to choose from  :

• Payment by check  : Please note that we only accept checks issued by a French bank and less than €200.

The buyer selects the products he wishes to order in the basket, modifies if necessary (quantity, references, etc.), checks the delivery address or enters a new one.

Then the shipping costs are calculated and submitted to the buyer as well as the delivery method.

Finally, the buyer is redirected to the secure Paypal interface in order to securely enter his PayPal account or personal credit card references.

If the payment is accepted, the order is recorded and the contract definitively formed.

• Payment by credit card on the eldonia.fr website

The buyer selects the products he wishes to order in the basket, modifies if necessary (quantity, references, etc.), checks the delivery address or enters a new one.

Then the shipping costs are calculated and submitted to the buyer as well as the delivery method.

Then the buyer chooses the method of payment of his choice  : “  payment by credit card  »

Finally, the last step offers him to check all the information, read and accept these general conditions of sale by ticking the corresponding box, then invites him to validate his order by clicking on the "  Validate my order  ".

If the payment is accepted, the order is recorded and the contract definitively formed.

The confirmation  of the order, whatever the method of payment, entails the recognition of having perfect knowledge of these conditions of sale and their acceptance.

Article 5- Retention of title

Eldonia retains full and entire ownership of the products sold until full payment of the principal price, including costs and taxes.

Article 6- Withdrawal

Under Article L121-18 of the Consumer Code, the buyer has a period of 14 (fourteen) working days from the delivery of his order to exercise his right of withdrawal and return the purchased product to seller for exchange or refund without penalty, except for return shipping costs. Eldonia will reimburse the buyer within 14 days from the day of withdrawal. However, reimbursement can only be made if the returned product is returned on time (14 days) and in perfect condition, complete and in its original packaging.

Article 7- Delivery

Deliveries are made to the address indicated by the buyer when ordering. Eldonia cannot be held liable for any error made when the buyer indicates the delivery address.

  1/Orders up to  30 kg are carried out by the Post Office via Colissimo, delivery service with follow-up and delivery without signature.

Eldonia may provide the buyer with a tracking number for their package by email.

The buyer will be delivered by the postman. In case of absence, the buyer will receive a delivery notice in his mailbox and can collect his package at the nearest post office, during the period indicated by the postal services. 

Delivery times by Colissimo are generally 48/72h (to be added to the 48h processing time). If the buyer has not received his package within 5 working days, he must immediately inform the company Eldonia who will question the postal services. If within 30 days the product is still not delivered, the company Eldonia will refund the purchased product.

Regarding packages over 30kg, they will be shipped by carrier. Consult us for prices and delivery times (delivery times which may be longer than those of the post office).

Whatever the means of delivery, the buyer is required to check, in the presence of the post office or delivery person, the condition of the packaging and its contents. In the event of damage to the package or its contents, written reservations must be made by the buyer. The latter can also refuse the package which will be returned to the company Eldonia. The latter will replace the product or refund it.

Article 8- Availability

All items for sale online are available, however an update period is necessary for the site after an order. Thus it is sometimes possible that articles having found  purchaser are indicated as still available for sale on the site. In the event of an unavailability of an order and the impossibility of replacing it with an equivalent product, the company Eldonia will proceed to the full refund of the unavailable article as well as the shipping costs associated with it.

Article 9- Intellectual property

All elements of the spinosaure.com website  are and remain the exclusive intellectual property of Eldonia. No one is authorized to reproduce, exploit or use for any purpose whatsoever, even partially, elements of the site whether in the form of a photo, logo, text or visual. The author of any fraudulent use will be prosecuted in court.

Article 10- Personal data

Eldonia undertakes to preserve the confidentiality of the information provided by the buyer, which he would have to transmit for the use of certain services.

Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the Internet user has a right to access, modify and delete information concerning him. Article 11- Settlement of disputes

These distance selling conditions are subject to French law. For any dispute or litigation, the competent Court will be that of Cusset (03).
